The Council of State is the political body of consultation of the President of the Republic.
The Council of State is chaired by the President of the Republic and composed of the following members:
- The President of the National Assembly;
- The Prime Minister;
- The President of the Constitutional Court;
- The Attorney General of the Republic;
- The President of the Prince's Regional Government;
- Former Presidents of the Republic who have not been removed from office;
- Three citizens of recognized repute and merit, appointed by the President of the Republic for the period corresponding to the duration of his term;
- Three citizens elected by the National Assembly, in accordance with the principle of proportional representation, for the period corresponding to the duration of the legislature.
Possession and mandate
The members of the Council of State are sworn in by the President of the Republic.
The members of the Council of State shall remain in office as long as they hold their respective positions until they are replaced by their respective officers.
Functioning and competence
The meetings of the Council of State are not public.
It is incumbent upon the Council of State:
- To elaborate its regiment;
- To pronounce on the dissolution of the National Assembly;
- To pronounce itself on the resignation of the Government, when it becomes necessary to ensure the regular functioning of the democratic institutions;
- To pronounce on the declaration of war and the making of peace;
- To pronounce on the treaties that involve restrictions of the sovereignty, the participation of the Country in international organizations of collective or military security;
- To pronounce on the participation of the Armed Forces in operations in foreign territory or the presence of foreign Armed Forces in national territory;
- To pronounce itself in the other cases provided for in the Constitution and, in general, to advise the President of the Republic in the performance of his duties, when he so requests.
The deliberations of the Council of State are not binding.
Form and publication of deliberations
The deliberations of the Council of State take the form of opinions.
The opinions of the Council of State shall be issued at a meeting convened by the President of the Republic and made public at the time of the act to which they refer.
